Profile
Justice for All, Regardless of Means
The promise of ”equal justice under law” is the cornerstone of the American legal system. The Shelby County Public Defender (Law Office of the Shelby County Public Defender) exists to fulfill this promise for those who cannot afford private counsel. Established in 1917 as the first public defender’s office east of the Mississippi River, this institution has a century-long legacy of protecting the rights of the indigent. Led by Chief Public Defender Phyllis Aluko, the office is staffed by a dedicated team of attorneys, investigators, and social workers. They provide zealous Criminal Defense Lawyers representation to adults and juveniles in Memphis and Shelby County, ensuring that poverty is not a barrier to a fair trial.
Comprehensive Defense Services
The office handles thousands of cases each year across the criminal justice spectrum. Their General Sessions team represents clients during initial appearances and preliminary hearings, often the most critical stage of a case. For more serious offenses, the Criminal Courts division handles felonies ranging from theft to capital murder. They also have specialized units, such as the Special Litigation Unit, which focuses on clients with severe mental illness, and the Juvenile Defender unit, which advocates for children in the juvenile justice system. Their holistic approach often involves connecting clients with social services to address the root causes of their legal involvement.
Situated at 201 Poplar
The Public Defender’s office is located in the Walter L. Bailey Criminal Justice Center, famously known in Memphis as ”201 Poplar.” This location places them directly within the courthouse and jail complex, allowing for immediate access to incarcerated clients. While they are court-appointed, they are independent advocates who fight vigorously against the prosecution. If you have been arrested and cannot afford to hire a lawyer, you have the right to request a public defender at your arraignment.
A Mission of Advocacy
Beyond individual casework, the Shelby County Public Defender engages in systemic advocacy to improve the criminal justice system. They work on initiatives related to bail reform, expungement, and re-entry support. Their attorneys are highly trained and deeply committed to the principle that every person deserves dignity and a rigorous defense.
- Felony Defense: Representation for serious criminal charges.
- Mental Health Court: Specialized defense for those with psychiatric needs.
- Juvenile Defense: Protecting the rights of youth in court.
- Re-Entry Support: Helping clients transition back into the community.
The office is located on the 2nd floor of 201 Poplar Avenue. Eligibility for services is determined by the court based on financial need.
