Circuit Court of Cook County – Probate Division
The Probate Division of the Circuit Court of Cook County is located within the Richard J. Daley Center. This specialized judicial division is responsible for overseeing the administration of estates for deceased individuals, as well as the protection of minors and disabled adults. The court ensures that assets are distributed correctly according to wills or state law and that vulnerable individuals have appointed guardians to manage their personal and financial affairs.
Key Responsibilities
- Decedents’ Estates: Adjudicating the validity of wills and supervising the distribution of assets for those who have passed away.
- Adult Guardianship: Appointing guardians for adults with disabilities who are unable to make decisions for themselves.
- Minor Guardianship: Establishing legal guardianship for children who are not in the care of their parents (and do not have a case in Juvenile Court).
Filing and Administration
The Probate Division works closely with the Clerk of the Circuit Court to manage case files. Many administrative matters can be handled at the counters on the 12th floor. Due to the complexity of probate law, the court often recommends that executors and petitioners seek legal counsel, although resources are available for self-represented litigants.
