Cumberland County Superior Court
The Cumberland County Superior Court, located in the historic Cumberland County Courthouse in downtown Portland, Maine, serves as the primary trial court of general jurisdiction for the region. As part of the State of Maine Judicial Branch, it handles a wide range of serious legal matters, distinguishing it from the District Courts which typically handle lesser offenses and civil disputes.
Jurisdiction and Case Types
The Superior Court is the only court in Maine that conducts jury trials. Its jurisdiction covers:
- Criminal Felonies: Processing of serious criminal charges (Class A, B, and C crimes), including murder, aggravated assault, and major theft.
- Civil Litigation: Handling of civil cases where the damages sought exceed a specific monetary threshold, as well as cases seeking equitable relief (injunctions).
- Appeals: Reviewing appeals from the District Court and administrative agencies.
- Grand Jury: Convening grand juries to determine if there is probable cause to indict individuals for criminal offenses.
Facility and Operations
The courthouse is a significant architectural landmark, originally built in 1910. Inside, the court maintains high security standards to ensure the safety of judges, staff, and the public. Visitors must pass through security screening upon entry. The Clerk’s Office provides administrative support, processing filings, managing dockets, and assisting with jury selection logistics. While the building is historic, it has been updated to include modern accessibility features.
Important Visit Information
Strict rules of conduct apply within the courtrooms. Electronic devices must often be silenced or turned off, and photography is generally prohibited without prior judicial authorization. The court operates Monday through Friday, handling a busy docket of arraignments, motions, trials, and sentencings. Parking in the downtown area can be challenging, so visitors are advised to utilize nearby public parking garages or public transportation.
