A Unique Check on Power
The New Hampshire Executive Council is a constitutionally mandated body that serves as a unique check on the power of the Governor, a system of governance found in few other states. Composed of five councilors elected every two years from five diverse districts, the Council shares executive authority with the Governor. Meeting regularly in the historic Executive Council Chamber within the State House, the Council’s primary responsibility is to ensure that the state’s business is conducted openly, fiscally responsibly, and in accordance with the law. While the Governor initiates policy, the ‘Governor and Council’ must act together to approve significant financial expenditures and high-level appointments, ensuring that the interests of citizens from the North Country to the Seacoast are represented.
Contract and Budget Oversight
One of the Council’s most critical functions is the approval of state contracts. Any state contract with a value exceeding a statutory threshold (typically $10,000) requires a majority vote of the Council to be valid. This oversight role effectively makes the Councilors the ‘watchdogs of the state treasury,’ reviewing millions of dollars in spending for infrastructure, healthcare, and public services to prevent waste and favoritism. They also play a key role in managing the state’s 10-Year Highway Plan, conducting hearings across the state to determine transportation priorities.
Appointments and Pardons
Beyond fiscal matters, the Executive Council holds the power of ‘advice and consent’ over the Governor’s nominations. This includes the confirmation of all state judges, the Attorney General, department commissioners, and members of hundreds of state boards and commissions. This vetting process ensures that appointees are qualified and accountable to the public. Additionally, the Governor and Council are the sole authority for granting pardons to individuals convicted of crimes in New Hampshire, a solemn power exercised only after careful review and public hearings.
District Representation
Each of the five Executive Councilors represents approximately 275,000 residents. They serve as a direct conduit between their constituents and the state government, often helping citizens navigate bureaucratic hurdles with state agencies. Their meetings are open to the public and provide a window into the inner workings of state administration, upholding New Hampshire’s tradition of accessible and transparent government.
