Pre-Trial Intervention Program
The Pre-Trial Intervention (PTI) program, located within the Hudson County Administration Building on Newark Avenue, is a diversionary program within the Superior Court of New Jersey’s Criminal Division. It is designed to offer an alternative to traditional criminal prosecution for first-time offenders. The goal of PTI is to provide rehabilitative services and supervision to defendants, allowing them to address the underlying causes of their criminal behavior—such as substance abuse or mental health issues—without incurring a permanent criminal conviction.
Eligibility and Application
Admission into the PTI program is not automatic; it requires a rigorous application and review process. Defendants generally apply for PTI at their first court appearance or shortly thereafter. The Criminal Division staff conducts comprehensive interviews and background checks to assess the candidate’s eligibility. Factors such as the nature of the offense, the defendant’s prior record, and the needs of the victim are carefully weighed. Acceptance into the program requires the consent of the Criminal Division Manager, the Prosecutor, and a Superior Court Judge.
Program Requirements
Once admitted, participants are supervised by probation officers and must comply with specific conditions tailored to their situation. These conditions may include community service, restitution to victims, psychological counseling, random drug testing, and regular reporting to the PTI office. The supervision period typically lasts from one to three years. Successful completion of the program results in the dismissal of the charges, offering the participant a clean slate and a second chance.
Termination and Consequences
Failure to adhere to the strict conditions of the PTI program can result in termination from the program. If a participant is terminated, their case is returned to the ordinary course of prosecution, and they face trial for the original charges. The PTI office monitors compliance closely to ensure that the integrity of the program is maintained while supporting the participant’s rehabilitation.
