Overview
About the Newark Zoning Board of Adjustment
The Newark Zoning Board of Adjustment (ZBA), located in City Hall at 920 Broad Street, is a quasi-judicial body empowered to hear and decide on appeals regarding the city’s zoning ordinances. Functioning independently of the City Council, the Board plays a critical role in urban development by granting relief from strict zoning regulations when specific legal criteria are met. This body ensures that land use within Newark balances individual property rights with the master plan and the welfare of the community.
Functions and Variances
The Board primarily handles applications for “variances”—permissions to depart from the literal requirements of the zoning code. Key responsibilities include:
- ”C” Variances (Bulk Variances): Relief from dimensional requirements such as setbacks, lot size, building height, or lot coverage.
- ”D” Variances (Use Variances): Permission to use a property for a purpose not permitted in that specific zone (e.g., commercial use in a residential zone) or to exceed density limits.
- Appeals: Hearing challenges to decisions made by the Zoning Officer or Administrative Officer.
- Interpretations: Clarifying the meaning of the zoning map or ordinance text.
Meetings and Public Hearings
The ZBA holds regular public hearings where applicants present their cases, and members of the public have the opportunity to comment or object. These meetings are governed by the New Jersey Municipal Land Use Law (MLUL). Decisions made by the Board are legally binding and can be appealed to the Superior Court. Applicants are often required to provide public notice to neighbors within 200 feet of the property in question before a hearing.
Visiting the Office
The administrative office for the Board is located in Room 112 of City Hall. Here, property owners and developers can file applications, review meeting agendas, and access public records related to past decisions. As the office is within City Hall, all visitors must adhere to building security protocols, including passing through metal detectors. The location is well-served by NJ Transit buses and is wheelchair accessible.
