Overview
The Legal Guardian of the Capital City
Corporation Counsel
The City of Albany Department of Law, led by the Corporation Counsel, serves as the chief legal advisor to the Mayor, the Common Council, and all city departments. Located in City Hall on Eagle Street, this office functions as a full-service municipal law firm. Its attorneys are responsible for drafting and reviewing all city legislation, including local laws and ordinances, before they are voted on by the Common Council. They also prepare and approve all legal instruments such as contracts, deeds, leases, and easements, ensuring that the city’s interests are protected in every transaction. The Corporation Counsel represents the city in all civil litigation, defending the municipality against lawsuits ranging from personal injury claims to civil rights allegations.
Code Enforcement and Prosecution
A significant portion of the department’s workload involves the enforcement of quality-of-life laws. The office prosecutes violations of the City Code, including building safety regulations, zoning ordinances, and traffic infractions. This team works closely with the Albany Police Department and the Department of Buildings and Regulatory Compliance to hold violators accountable, handling over 20,000 vehicle and traffic cases annually in City Court. Their aggressive enforcement of housing codes helps combat blight and ensures safe living conditions for residents.
Claims and Ethics
The Law Department is also the first stop for anyone wishing to file a legal claim against the city. They process ‘Notices of Claim’ and manage the subsequent investigation and defense. Furthermore, the office provides ethical guidance to city officials and manages the Freedom of Information Law (FOIL) appeals process, balancing the public’s right to know with necessary legal privileges. Whether negotiating complex development agreements or advising on labor disputes with municipal unions, the Department of Law is integral to the orderly governance of Albany.
