Overview
NYS Office of Professional Discipline
The Office of Professional Discipline (OPD) is the investigative and prosecutorial arm of the New York State Education Department’s Office of the Professions. Headquartered in the State Education Building on Washington Avenue in Albany, the OPD is tasked with upholding the integrity of over 50 licensed professions, ranging from architecture and engineering to nursing, pharmacy, and public accountancy. The office’s primary mission is to protect the public by investigating allegations of professional misconduct, illegal practice, and gross incompetence. Note that this office does not handle complaints regarding physicians (which are handled by the Department of Health) or attorneys (who are disciplined by the court system).
Investigations and Enforcement
When a complaint is filed against a licensed professional or an individual practicing without a license, the OPD conducts a thorough investigation. This can involve interviewing witnesses, reviewing records, and conducting site visits. If evidence of misconduct is found, the office may pursue disciplinary actions ranging from fines and reprimands to the suspension or revocation of a professional license. The Albany office serves as the central hub for these operations, coordinating with regional offices across the state to ensure consistent enforcement of the Education Law and the Rules of the Board of Regents.
Public Protection Services
The OPD provides a critical mechanism for consumers to report concerns about the services they receive. By maintaining high standards of professional conduct, the office ensures that New Yorkers can trust the qualifications and ethics of the experts they hire. The office also works to educate professionals about their legal and ethical obligations. While the disciplinary process is confidential during the investigative stage, final disciplinary actions are matters of public record, allowing citizens to verify the standing of a professional before engaging their services.
