Overview
Allegheny County Orphans’ Court Division
Judicial Role and Mission
The Allegheny County Orphans’ Court, a specialized division of the Court of Common Pleas, serves as the primary judicial body responsible for protecting the personal and property rights of individuals who may be unable to protect themselves. Established as part of Pennsylvania’s Unified Judicial System, this court operates with a specific jurisdiction focused on probate, estates, and family-related legal matters. Located in the historic Frick Building on Grant Street in downtown Pittsburgh, the court ensures the proper administration of justice regarding the transfer of wealth, the care of minors and incapacitated persons, and the formalization of adoptions.
- Probate and Estates: Oversees the administration of decedents’ estates, the validity of wills, and the distribution of assets to heirs and beneficiaries.
- Adoptions: Manages all termination of parental rights and adoption proceedings, including domestic, foreign, and adult adoptions.
- Guardianships: Appoints and supervises guardians for minors and incapacitated adults to ensure their financial and personal well-being.
- Marriage Licenses: While issued by the Marriage License Bureau, the Orphans’ Court oversees legal disputes or special petitions regarding marriage applications.
- Trusts and Audits: Reviews accountings of trusts and estates to ensure fiduciaries are acting in accordance with the law.
Court Operations and Procedures
The Orphans’ Court Division handles a high volume of sensitive cases requiring meticulous attention to detail. The Department of Court Records acts as the filing office for the division, where all petitions, motions, and accountings must be lodged. Audit hearings are a central function, where the court examines the financial records of estates and trusts before authorizing final distribution. For adoptions, the court provides a confidential and dignified environment to finalize the legal expansion of families. In matters of civil commitment, the court balances individual liberties with the need for mental health treatment under the Mental Health Procedures Act. The court also holds jurisdiction over non-profit associations and inheritance tax disputes with the Commonwealth of Pennsylvania.
Visitor Information and Rules
Visiting the Orphans’ Court requires adherence to strict protocol. All visitors must pass through security screening upon entering the Frick Building. Cell phones must be silenced or turned off inside courtrooms. Appropriate business attire is expected for all attorneys and parties appearing before the judges. The court operates primarily on weekdays, and while some records are public, adoption and guardianship files are often sealed to protect privacy. Access to the Marriage License Bureau or the Wills/Orphans’ Court filing desk is typically available during standard county business hours.
