Overview
About the Law Department
The Worcester Law Department, located in Room 301 of City Hall, serves as the central legal counsel for the municipal government. Led by the City Solicitor, this department provides comprehensive legal advice and representation to the City Manager, City Council, and all city departments, boards, and commissions. Their primary function is to ensure that the city operates within the bounds of local, state, and federal laws. This includes drafting and reviewing municipal ordinances, managing litigation where the city is a party, and negotiating contracts. For the general public, the Law Department is the designated entity for processing claims against the city. If a resident suffers property damage or injury due to an alleged defect in public infrastructure (such as a pothole or sidewalk issue), the claim must be filed through this office or the City Clerk, adhering to strict statutory deadlines.
Claims and Litigation
The department manages the city’s liability regarding negligence claims. It is important for residents to understand that under Massachusetts law, the city’s liability is often limited. The Law Department investigates claims to determine if the city was negligent in responding to a known dangerous condition.
- Filing a Claim: Claims regarding defects in public ways must typically be filed within 30 days of the incident. Forms are available online or at the City Clerk’s office.
- Insurance: The department coordinates with insurance providers to handle coverage for city assets and liabilities.
