Overview
Legal Process Service in Worcester County
The Civil Process Division of the Worcester County Sheriff’s Office is the specialized unit responsible for the service and enforcement of civil legal documents throughout the county’s 60 cities and towns. Operating under the authority of Sheriff Lew Evangelidis, this division ensures that due process is upheld by delivering court orders to the correct parties in a timely and professional manner. Unlike the patrol division or corrections staff, the deputies here focus strictly on civil matters, acting as the bridge between the court system and the public. The office is located in downtown Worcester at 240 Main Street, separate from the main courthouse, providing a dedicated space for attorneys and plaintiffs to file requests for service.
Services and Documents Served
- Summons and Complaints: Notification to defendants of legal actions taken against them in various courts.
- Subpoenas: Legal orders compelling individuals to appear in court or produce evidence.
- Evictions (Summary Process): Execution of court-ordered evictions and lockouts, restoring property possession to landlords.
- Asset Recovery: Enforcing writs of attachment and executions, including seizing vehicles or levying bank accounts to satisfy judgments.
- Capias Arrests: Apprehending individuals who have failed to appear in court for civil matters.
Filing and Payment Policies
To have a document served, plaintiffs or their attorneys must provide the original paperwork along with the required copies. This is a fee-for-service division; costs vary depending on the type of document and the distance traveled for service. Payments are accepted via check, money order, or cash; credit cards are generally not processed at the counter. Importantly, while the division honors court-approved Affidavits of Indigency (fee waivers) for many services, certain high-risk or complex enforcement actions—such as Capias arrests—may not be covered by these waivers and will still require payment. Documents received by 10:00 AM are typically sent out for service on the same business day.
Jurisdiction and Access
The jurisdiction of this office covers the entirety of Worcester County, the largest county in Massachusetts. The deputies are sworn law enforcement officers with the authority to serve process anywhere within this territory. The downtown Worcester office is easily accessible via public transit and is situated near the major courthouses, facilitating quick coordination with the courts. Visitors should be aware that while this is an administrative office, it is a law enforcement facility, and standard security protocols regarding weapons and conduct are enforced.
