Kings County Surrogate’s Court
The Kings County Surrogate’s Court handles all issues related to the estates of deceased residents of Brooklyn (Kings County). Located in the Supreme Court Building at 2 Johnson Street in the Civic Center of Downtown Brooklyn, this court presides over the probate of wills, the administration of intestate estates, and various proceedings related to trusts and guardianships. The court plays a vital role in ensuring the orderly transfer of assets and the protection of the rights of heirs, beneficiaries, and creditors.
Jurisdiction and Functions
The Surrogate’s Court has broad jurisdiction over the affairs of decedents, including the validity of wills and the appointment of fiduciaries. It also shares concurrent jurisdiction with the Family Court over adoption proceedings and guardianships of infants and intellectually disabled persons.
- Probate: Proving the validity of a Last Will and Testament.
- Administration: Managing the estates of individuals who die without a will (intestate).
- Guardianship: Appointing guardians for the person and property of minors and incapacitated adults (Article 17 and 17-A).
- Accounting: Reviewing and settling the financial accounts of executors and administrators.
Departments and Records
The court is divided into specialized departments to assist the public and legal professionals. The Probate Department handles filings related to wills, while the Administration Department deals with estates where no will exists. The Record Room provides access to public records, including filed wills and decrees. While the court encourages the use of the New York State Courts Electronic Filing (NYSCEF) system for attorneys, pro se litigants may still file documents in person.
Visit and Security
Visitors to the courthouse must pass through security screening, including magnetometer checks. Electronic devices are generally permitted but must be silenced in courtrooms. The court operates Monday through Friday, with specific calendar calls for motions and process proceedings scheduled by the presiding Surrogates.
