Overview of the Orphans’ Court
The Dauphin County Orphans’ Court Division, often associated with the Register of Wills, is a specialized branch of the Court of Common Pleas responsible for protecting the personal and property rights of individuals who may not be able to manage their own affairs. This includes minors, incapacitated persons, and decedents’ estates. Marriage Licenses
One of the most common reasons residents visit this office is to obtain a marriage license. The Orphans’ Court processes applications for all couples planning to wed within the Commonwealth of Pennsylvania. The office has modernized its operations to include virtual marriage license appointments, allowing applicants to complete much of the process remotely. Key requirements typically include:
- Application: Both parties must appear (virtually or in-person) to apply.
- Waiting Period: A mandatory three-day waiting period is required by Pennsylvania law before the license becomes valid.
- Validity: Once issued, the license is valid for 60 days and can be used in any county within Pennsylvania.
Adoptions and Guardianships
The Orphans’ Court handles sensitive legal matters involving the welfare of children and incapacitated adults. This includes the finalization of adoptions, ensuring that legal parent-child relationships are established securely. Additionally, the court oversees guardianship proceedings for individuals who are unable to manage their own financial or medical decisions due to age or disability, appointing responsible guardians to act in their best interests.
Estate Administration
While the Register of Wills handles the initial probate of wills, the Orphans’ Court adjudicates disputes related to the administration of estates and trusts. If conflicts arise regarding the distribution of assets, the validity of a will, or the conduct of an executor, these matters are heard and resolved within this division. The Clerk of the Orphans’ Court maintains all dockets and records related to these proceedings, dating back to the county’s formation.
Operational Details
The office operates Monday through Friday. While walk-ins are often accepted for general filings, appointments are strongly recommended for marriage license applications and specific probate matters to ensure staff availability. The office strictly adheres to a no-cash policy for certain transactions, preferring checks, money orders, or credit cards for fees.
