Overview
VOSHA Review Board
The VOSHA Review Board is an independent quasi-judicial state agency within the executive branch of the Vermont government. Established to ensure fair adjudication of workplace safety disputes, the Board operates separately from the Vermont Department of Labor. Its primary function is to hear and decide on contested citations issued by the Vermont Occupational Safety and Health Administration (VOSHA) against employers for alleged violations of workplace safety standards.
Adjudication and Appeals
When an employer contests a citation or penalty issued by VOSHA, the Review Board serves as the neutral forum for the dispute. The process involves:
- Hearings: Conducting formal hearings where both the Department of Labor and the employer can present evidence and legal arguments.
- Review: Administrative Law Judges or the Board itself review the facts to determine if the safety citations should be upheld, modified, or dismissed.
- Decisions: Issuing final orders that are binding unless appealed to the Vermont Supreme Court.
Office Information
The Board’s administrative office is located in Montpelier. While the physical intake is listed at 13 Baldwin Street, the official mailing address for legal filings and correspondence is 6 Baldwin Street. The office maintains specific hours of operation, typically in the mornings, for administrative purposes. As a judicial body, it does not provide legal advice to the public but offers procedural guidance on how to file contests and manage cases.
