Overview
U.S. Court of Appeals for the Third Circuit
The U.S. Court of Appeals for the Third Circuit is a federal appellate court exercising jurisdiction over the District Courts of Pennsylvania, New Jersey, Delaware, and the Virgin Islands. Established in 1891, this tribunal serves as the intermediate level of the federal judiciary, positioned between the district trial courts and the U.S. Supreme Court. The court sits primarily in Philadelphia at the James A. Byrne U.S. Courthouse, a significant federal landmark in the heart of the city’s historic district.
Appellate Jurisdiction and Functions
As one of the thirteen United States Courts of Appeals, the Third Circuit reviews final decisions and specific interlocutory orders from district courts within its geographic boundaries. The court does not conduct retrials or hear witness testimony; instead, panels of three judges analyze the legal proceedings of lower courts to determine if errors of law occurred.
- Case Review: Evaluation of civil, criminal, and bankruptcy appeals.
- Agency Oversight: Review of rulings from federal administrative agencies.
- Oral Arguments: Scheduled hearings where attorneys present legal arguments before a judicial panel.
- Mediation Program: A dedicated appellate mediation office to facilitate settlements in civil cases.
The James A. Byrne U.S. Courthouse
The court operates out of the James A. Byrne United States Courthouse, located at 601 Market Street. This facility shares space with the U.S. District Court for the Eastern District of Pennsylvania and is situated directly across from Independence Mall. The courthouse features advanced security protocols, multiple courtrooms equipped for appellate arguments, and the Circuit Executive’s Office. The building is fully accessible to the public, though visitors must adhere to strict entry guidelines.
Clerk’s Office and Filing
The Office of the Clerk acts as the administrative hub, managing the court’s docket, processing filings, and maintaining official records. While the court has transitioned to a mandatory electronic filing system (CM/ECF) for attorneys, the Clerk’s Office assists pro se litigants and manages the physical intake of documents when necessary.
