The Office of Bar Counsel (OBC) acts as the independent prosecutor for attorney disciplinary matters in Massachusetts. Established by the Supreme Judicial Court and operating in conjunction with the Board of Bar Overseers (BBO), the OBC is responsible for investigating allegations of unethical conduct against lawyers licensed in the Commonwealth. When misconduct is identified, the OBC prosecutes these cases before the BBO and, when necessary, the Supreme Judicial Court.

Consumer Assistance (ACAP)

A key service provided by the OBC is the Attorney and Consumer Assistance Program (ACAP). This intake unit serves as the first point of contact for individuals who have concerns about their lawyer. ACAP staff can often resolve minor disputes—such as a lack of communication or delay in returning a file—without the need for a formal disciplinary investigation. This service helps bridge the gap between clients and attorneys, providing a quick resolution for common frustrations. If a matter is serious, ACAP assists the complainant in filing a formal grievance.

Location and Contact

The Office of Bar Counsel is located at One Beacon Street, 10th Floor, in downtown Boston. This is a recent move (as of June 2024) from their previous location on High Street. The office is situated in a major commercial high-rise near Government Center. Visitors should be prepared to present identification at the building's security desk. While the OBC handles complaints, it cannot provide legal advice or represent individuals in court. Attorneys seeking ethical guidance can utilize the OBC's Ethics Helpline during specific hours (typically Mondays, Wednesdays, and Fridays).

Jurisdiction

The OBC's jurisdiction is strictly limited to the ethical conduct of attorneys. It does not have the authority to discipline judges (who are overseen by the Commission on Judicial Conduct) or to resolve fee disputes (which are often referred to bar association arbitration boards). The office is funded entirely by the annual registration fees paid by Massachusetts attorneys, receiving no tax dollars.
