New Jersey Council on Local Mandates
The New Jersey Council on Local Mandates is a unique, independent constitutional authority created to resolve disputes regarding ”unfunded mandates.” Established under the ”State Mandate, State Pay” amendment to the New Jersey Constitution, the Council operates independently of the Executive, Legislative, and Judicial branches of state government. Its primary function is to adjudicate complaints filed by counties, municipalities, or school boards alleging that a state law, rule, or regulation imposes a mandatory expenditure without authorizing the resources to pay for it.
Authority and Rulings
The Council holds significant quasi-judicial power within the state’s governance structure:
- Adjudication: It has the exclusive authority to rule on whether a specific statute or regulation constitutes an unconstitutional unfunded mandate.
- Effect of Rulings: If the Council determines a mandate is unfunded, that specific provision ceases to be mandatory and effectively expires. These rulings are final and not subject to further judicial review.
- Membership: The body consists of diverse members appointed by the Governor, Legislative leaders, and the Chief Justice of the Supreme Court to ensure bipartisan and impartial decision-making.

The Council does not oversee general consumer complaints or criminal matters. Its jurisdiction is strictly limited to disputes between local government units and the State regarding financial mandates. Complaints must be filed in writing, and the Council conducts hearings where evidence and legal arguments are presented. The Council’s decisions and procedural histories are matters of public record.
