New Jersey Real Estate Commission (REC)
The New Jersey Real Estate Commission (REC) serves as the state regulatory body responsible for the administration and enforcement of New Jersey’s real estate licensing laws. Operating as a division within the New Jersey Department of Banking and Insurance (DOBI), the commission is tasked with protecting the public interest by ensuring that all real estate brokers, salespersons, and referral agents adhere to strict professional standards. The REC oversees the licensure of tens of thousands of real estate professionals and regulates the conduct of real estate schools and instructors throughout the state.
Licensing and Regulation
The core function of the REC is the management of real estate licenses. This includes:
- License Issuance and Renewal: Processing applications for new licenses and managing the biennial renewal cycle for brokers and salespersons.
- Education Oversight: Approving pre-licensure and continuing education courses to ensure professionals maintain current knowledge of laws and ethics.
- Investigations: Reviewing complaints filed by consumers against licensees and conducting audits of broker escrow accounts to prevent financial mismanagement.
Disciplinary Authority
The Commission acts as a quasi-judicial body with the authority to hold hearings on contested license applications and disciplinary matters. If a licensee is found to have violated the Real Estate License Act, the REC has the power to revoke or suspend licenses, impose fines, and mandate restitution to aggrieved parties. The commission also administers the Real Estate Guaranty Fund, which provides a safety net for members of the public who suffer financial loss due to the dishonest conduct of a licensee.
Location and Access
The REC’s offices are located in the Department of Banking and Insurance building in downtown Trenton. As a government facility, access is controlled, and visitors may be subject to security screening. However, the vast majority of interactions with the commission—including license renewals, status checks, and initial applications—are designed to be handled remotely through the state’s online licensing services portal (PSI), reducing the need for in-person visits.
