The Inheritance and Estate Tax Branch, a specialized unit within the New Jersey Division of Taxation, is responsible for the administration and collection of death taxes in the state. Located in the Taxation Building at 50 Barrack Street, this office processes returns for the New Jersey Inheritance Tax, which is based on the relationship between the decedent and the beneficiary, and the Estate Tax (for deaths occurring prior to January 1, 2018). A critical function of this bureau is the issuance of Inheritance Tax Waivers. These legal documents are required by financial institutions to release frozen assets, such as bank accounts, stocks, and bonds, from the name of a decedent to their beneficiaries.
Filing and Audit Procedures
Executors, administrators, and legal representatives interact with this branch to file returns (Forms IT-R and IT-Estate) and settle tax liabilities. The bureau conducts audits of filed returns to ensure accurate valuation of assets and proper calculation of tax owed. It also handles the ‘L-8’ Self-Executing Waiver forms for specific Class A beneficiaries. The staff provides guidance on the complex regulations governing tax exemptions, particularly for spouses, children, and charitable organizations.

The office is situated in downtown Trenton near the State House complex. As a secure government facility, visitors must present valid government-issued photo identification and pass through security screening, including metal detectors. While many inquiries can be handled via phone or mail, the building is accessible to the public for specific tax matters.
