Overview
Overview of the Office
The New Jersey Office of the Public Defender (OPD) – Mercer Trial Region is a state-funded agency dedicated to providing legal representation to citizens who cannot afford private counsel. Located on South Broad Street in Trenton, this office serves as the primary defense counsel for indigent defendants facing prosecution in Mercer County. Established to uphold the constitutional right to an attorney, the OPD ensures that financial hardship does not deprive individuals of fair and competent legal defense. The office handles a wide spectrum of cases, primarily focusing on indictable criminal offenses (felonies) and juvenile delinquency matters. It operates independently of the prosecutor’s office and the courts to guarantee zealous advocacy for its clients.
Scope of Legal Services
The Mercer Trial Region office provides representation in several key areas of the criminal justice system:
- Adult Criminal Defense: Representing individuals charged with indictable offenses in the Superior Court of New Jersey. This includes pre-trial motions, plea negotiations, and trial defense.
- Juvenile Defense: Advocating for minors charged with delinquency offenses, with a focus on rehabilitation and the best interests of the child.
- Drug Court: assisting eligible non-violent offenders in navigating the specialized Drug Court program, which emphasizes treatment and recovery over incarceration.
- Intensive Supervision Program (ISP): Providing counsel for clients applying for early release into strict community supervision.
Eligibility and Application
Legal representation by the Public Defender is not automatic; it is based on financial need. Defendants must apply for services, typically during their first court appearance or at the intake unit. The court determines eligibility by evaluating the defendant’s income, assets, and family size against established guidelines. While the constitution guarantees the right to counsel, the state may assess a lien against a client’s future assets or income to recoup some costs of representation, although services are never denied due to immediate inability to pay.
Visiting the Office
The office is located at 210 South Broad Street, situated near the Mercer County Criminal Courthouse. Clients are generally seen by appointment to ensure their assigned attorney is available. Visitors should be prepared to present valid photo identification upon entering the building. As a legal office handling sensitive and confidential case information, strict privacy protocols are observed. Friends and family members may not be permitted to sit in on attorney-client meetings to preserve the attorney-client privilege.
Conflict of Interest
In cases where the Mercer Trial Region office has a conflict of interest—such as multiple co-defendants in a single case—representation is assigned to a ‘pool attorney’ (private counsel paid by the state) or a separate conflict region office to ensure unbiased and independent defense for every client.
