The Mercer County Surrogate’s Office functions as the administrative arm of the Surrogate’s Court, a department of limited jurisdiction responsible for probating wills and overseeing the administration of estates. Located within the Civil Courthouse at 175 South Broad Street, the Surrogate acts as the Judge of this court and also serves as the Deputy Clerk of the Superior Court, Chancery Division, Probate Part. The office is the primary venue for families dealing with the loss of a loved one, handling the validation of wills, the appointment of executors and administrators, and the resolution of disputes regarding estate assets.
Adoptions and Minors’ Funds
Beyond estate matters, the Surrogate’s Office plays a vital role in protecting the interests of minors and incapacitated adults. It manages the Minors’ Intermingled Trust Fund, holding proceeds from lawsuits, inheritances, or insurance policies for children until they reach the age of majority. The office also processes filings for all adoptions in the county, ensuring compliance with state laws before scheduling hearings in the Family Part of the Superior Court. Additionally, it oversees the appointment of guardians for individuals deemed incapacitated, safeguarding their personal and financial well-being.

The office acts as a filing and record-keeping center. While many records dating back to the county’s founding in 1838 are available, visitors should note that adoption records are sealed and require a court order to access. The facility is located on the 4th floor (Room 420) of the Civil Courthouse. Visitors must pass through standard courthouse security, including metal detectors. The location is easily accessible via public transportation, situated near the Trenton Transit Center.
