New Jersey Superior Court, Appellate Division
The Appellate Division of the Superior Court of New Jersey acts as the state’s intermediate appellate court. Headquartered within the Richard J. Hughes Justice Complex in Trenton, this court reviews decisions made by the trial courts (Tax, Chancery, and Law Divisions) and state administrative agencies. It is one of the busiest appellate courts in the nation. Unlike trial courts, the Appellate Division does not hear witness testimony or retry facts; instead, panels of two or three judges review the legal records and arguments to determine if errors of law were made in the lower proceedings. The Clerk’s Office at this location serves as the administrative hub, processing all notices of appeal, motions, and briefs filed by attorneys and self-represented litigants. The Clerk of the Appellate Division is responsible for the non-judicial operations of the court. This office manages the intake of thousands of appeals annually, ensuring that all filings comply with the Rules of Court. Staff in the Clerk’s Office assist with case scheduling, maintain the official case files, and communicate court orders and opinions to the parties involved. While the staff can answer procedural questions regarding forms, fees, and deadlines, they are strictly prohibited from providing legal advice or predicting the outcome of a case. The office has increasingly moved toward electronic filing (eCourts), but it remains the central point of contact for the public and the legal community regarding appellate matters.
Location and Access
The Appellate Division is housed in the Richard J. Hughes Justice Complex, a major government facility that also contains the New Jersey Supreme Court and the Attorney General’s office. Access to the building is strictly controlled. Visitors must pass through comprehensive security screening, including metal detectors and X-ray machines for bags. Identification is typically required for entry. The Justice Complex is located near the State House and other government buildings, creating a formal and secure environment. The courtrooms here are used for oral arguments, which are open to the public, although many cases are decided on the papers without oral argument.
Jurisdiction and Procedures
The jurisdiction of the Appellate Division is statewide. This means that regardless of which county a trial took place in, the appeal is processed through this central system, though arguments may be heard in various locations around the state. The court handles a diverse array of cases, including criminal convictions, civil disputes, family law matters, and challenges to government agency rulings. The decisions issued by the Appellate Division are binding on trial courts. If a party is dissatisfied with an Appellate Division ruling, they may petition the New Jersey Supreme Court for certification, although the Supreme Court accepts only a small percentage of cases for further review.
